Division 1 Preferences

Pursuant to the Amended Order re: Suspension of Proceedings, Circuit Court Division 1 shall implement the following procedures until Court operations are back to normal following the coronavirus pandemic.

NON-DISPOSITIVE MOTIONS SET BY DIVISION 1

Non-dispositive Motions Dates -

Thursday, April 9, 2020

Friday, April 17, 2020

Friday, April 24, 2020

Friday, May 1, 2020

All non-dispositive motions will be considered on brief only without oral argument. All motions, responses and reply shall be timely filed in compliance with the applicable Local Rules and Tennessee Rules of Civil Procedure. All non-dispositive motions shall be set by sending an email to circuit.division1@shelbycountytn.gov. Please be sure to include the date the motion is to be heard, style, docket number, title of motion, contact information (Name & Phone number) for attorneys of record or pro se litigants.

The Court will issue a ruling granting or denying the motion which will be posted on the Circuit Court website under the case docket report by Monday of the following week; or attorneys and self represented parties may also contact Bryant Bailey via email at circuit.division1@shelbycountytn.gov to obtain the ruling via email.

Parties shall submit an Order within seven (7) days in accordance with the local rules. The Order may be submitted via email at circuit.division1@shelbycountytn.gov or placed in the Division 1 Orders Box in Room 208.Please make sure all required signatures and/or certificate of service are on the Order.

DISPOSITIVE MOTIONS SPECIALLY SET BY DIVISION 1

All dispositive motions will be specially set in Division 1 by contacting Bryant Bailey via email at circuit.division1@shelbycountytn.gov. All motions, responses and replies shall be timely filed in accordance with the Local Rules and Tennessee Rules of Civil Procedure. All oral arguments shall be via Court Call. If you are not registered via Court Call, you may register via CourtCall.com or call 888-882-6878 for assistance. Zoom may be an option for remote appearances if Court Call is not an option.

Once a ruling on the motion is issued, the Order shall submitted via email at circuit.division1@shelbycountytn.gov or placed in the Division 1 Orders Box in Room 208 within seven (7) days of the ruling. Please make sure all required signatures and/or certificate of service is on the Order.

UNCONTESTED DIVORCES SET BY DIVISION 1

All hearings for uncontested divorces with and without children will be conducted on Wednesday April 8th, 15th, 22nd and 29th from 9:00 am to 12:00 noon via Affidavit. No court appearance is required.

Please contact Bryant Bailey via email at circuit.division1@shelbycountytn.govto schedule an uncontested divorce. Please file the Plaintiff’s Affidavit, Agreed Parenting Plan, Insurance Notification, Costs Bill, Health Insurance Form and any other documents that need to be filed by close of business Friday preceding your hearing date. It is very important that you adhere to this requirement so the Divorce Referee and Court have all documents filed and time to review them prior to the scheduled hearing.

The Final Decree shall be submitted via email at circuit.division1@shelbycountytn.gov or placed in the Division 1 Orders Box in Room 208.Please make sure all required signatures and/or certificate of service is on the Order.

ORDER OF PROTECTION, EMERGENCY CHILD CUSTODY MATTERS, PETITIONS FOR INJUNCTIVE RELIEF SET BY DIVISION 1

Pursuant to the Amended Supreme Court Order, Division 1 will make arrangements to conduct in Court proceedings adhering to the social distancing and other guidelines set forth in the Supreme Court Order. If you have a case already scheduled in April or needs to be scheduled in April please contact Bryant Bailey via email at circuit.division1@shelbycountytn.gov. It may be necessary to conduct a telephone conference with the attorneys and self represented litigants to coordinate specific details for the in Court hearing.

OTHER PETITIONS (DOMESTIC & NON-DOMESTIC)

MINOR SETTLEMENTS, WRITS OF INQUIRY SET BY DIVISION 1

If you have petition, minor settlement or writ of inquiry already scheduled for a hearing in April or needs to be scheduled for a hearing in April, please contact Bryant Bailey via email at circuit.division1@shelbycountytn.gov and the Court will do its best to schedule a hearing for all interested parties, witnesses, etc. to appear via Court Call. If you are not registered with Court Call, you may register via CourtCall.com or call 888-882-6878 for assistance. Zoom may be an option for remote appearances if Court Call is not an option.

If a party or parties prefer to have an in Court hearing they may request a continuance via email (after conferring with all interested parties) and the Court will schedule a telephone conference promptly to address the request.

JURY TRIAL AND BENCH TRIALS (including contested divorces)

All jury trials and bench trials scheduled during the month of April will be reset. Please send an email to Bryant Bailey at circuit.division1@shelbycountytn.gov with your docket number and preference dates to reset your case after conferring with your opposing party regarding available dates. Once a new trial date is reset, the parties will need to submit an Order with the new date to ensure all parties have proper notice of the new trial date.

The Order shall be submitted via email at circuit.division1@shelbycountytn.gov or placed in the Division 1 Orders Box in Room 208.Please make sure all required signatures and/or certificate of service are on the Order.

STATUS CONFERENCES

All status conferences scheduled in the month of April will be reset to May 13, 2020 at 10:00 am unless the Supreme Court Order is extended.

If the parties need a status conference before May 13, 2020 for any reason, please contact Bryant Bailey via email at circuit.division1@shelbycountytn.gov to schedule a time for a status conference via telephone.
