Ad Hoc Educational Amendments

Plan A

 

This document is a list of proposed amendments to the funding proposal presented by the Memphis City School Board and Shelby County School Board at the February 21, 2009 meeting of the Ad Hoc Committee on Public Education Funding Solutions.

 

PROPOSED MULROY AMENDMENTS TO THE SCHOOL DISTRICTS'S DRAFT BILL LANGUAGE TO EFFECTUATE I TS  JOINT SINGLE-SOURCE TAXATION AUTHORITY ENABLING LEGISLATION

 

Proposed Amendment 1:   Section 2A:  Add numbered section (3) to read as follows:

 

(3) For either the Memphis City or Shelby County Board of Education, no change in the number of members of that body which affects voting on the Single Source Funding Board shall be effected without approval of two-thirds of the members of the Single Source Funding Board. 

 

 

Proposed Amendment 2:   Section 3:   DELETE the following text:

 

"No real or personal property located within the SSFD shall be exempted from the requirement of paying this tax including but not limited to properties subject to agreements for payment in lieu of taxes which are entered into after the passage of this Act." 

 

Proposed Amendment 3:  Add a new Section 3, entitled "Process Of Implementation," and renumber all subsequent sections accordingly.

                New Section 3 shall read as follows:

 

"The Single Source Funding Board shall not be established unless and until its establishment and its taxing authority are approved by the voters of Shelby County in a countywide referendum to take place at a regularly scheduled countywide election occurring on or after August of 2010."

 

Pursuant to this new Section 3, Section 1.A.  shall be amended so that the first sentence reads as follows:

 

"A Single Source Funding District may be created and established pursuant to the procedures spelled out in Section 3.  If so created, this entity shall be known as the Shelby County Single Source Funding District (hereafter "District" or SSFD)."
