Uncontested Divorce Requirements
– Uncontested divorces with a Marital Dissolution Agreement (MDA) involving no minor children must be scheduled on a valid hearing date, sixty-one (61) or more calendar days after the initial Filing Date. Uncontested divorces with minor children must be scheduled on a valid hearing date, ninety-one (91) or more calendar days after the initial Filing Date. Uncontested divorces with an “Order for Default Judgment” must be scheduled on a valid hearing date at least three (3) weeks after the date the “Order” was signed.

PLEASE NOTE: Part II does not hear Uncontested Divorces on the first Monday of each month. Any Uncontested Divorces accidentally set on those Mondays will be struck and reset by Part II’s courtroom clerk.
